S. Gardner Culpepper, III

Overview

Gardner Culpepper specializes in complex civil litigation.  The 2012 edition of Benchmark Litigation recommends Gardner as a Litigation Star in Georgia. And, in 2009, he was identifed by Atlanta's Daily Report as one of the top 12 lawyers under 40 in Atlanta. 

Gardner focuses his defense practice on class actions, product liability and warranty disputes, restrictive covenant litigation, construction matters and business torts of all kinds, most recently in the building product, technology and healthcare sectors.  He also has substantial arbitration experience, including International Chamber of Commerce ("ICC") arbitrations.  Gardner further represents plaintiffs and defendants in insurance coverage matters and individual plaintiffs with catastrophic injuries.

Representative Experience

• National coordinating defense counsel for one of the country's largest manufacturers of building and paper products in multiple individual plaintiff and putative class action matters wherein plaintiffs allege claims sounding in strict liability, negligence, breach of warranty and deceptive trade practices.
• Defense counsel in numerous restrictive covenant and trade secret matters for one of the country's largest investment banks and one of the region’s largest resellers of technology equipment.
• Co-defense counsel with other large national and international firms representing one of the world's largest wireless telecommunications companies in multiple international licensing and intellectual property disputes with hundreds of millions of dollars at issue, including two in the ICC.
• Plaintiff's counsel obtaining large settlement against home healthcare agency in catastrophic personal injury matter.
• Plaintiff's counsel successfully establishing and preserving insurance coverage for corporate and individual clients.
• Defense counsel in multiple defamation and business tort cases throughout the Southeast for one of the largest telecommunications services providers in the United States.
• Trial counsel in multiple medical malpractice actions, representing physicians insured by one of the country's largest physician-owned malpractice insurance carriers.
