Representative Matters

Federal Appellate Cases
– Representing Fortune 50 company in the U.S. Court of Appeals for the Fifth Circuit in connection with claims relating to the Deepwater Horizon oil spill
– Appellate counsel for investment advisory firm and its principals in appeal to the U.S. Court of Appeals for the D.C. Circuit raising constitutional, statutory and other challenges to Securities and Exchange Commission ruling
– Representing a class of individuals in age discrimination case currently pending before the en banc U.S. Court of Appeals for the Eleventh Circuit involving the equitable tolling doctrine and the scope of the “disparate impact” provisions of the Age Discrimination in Employment Act
– Successfully defended clients in the U.S. Court of Appeals for the Eleventh Circuit in connection with federal securities law claims arising out of a buy/sell agreement.
– Won affirmance by the U.S. Court of Appeals for the Eleventh Circuit of trial court’s dismissal of shareholder derivative action and award of attorneys’ fees for our client
– Secured affirmance by the U.S. Court of Appeals for the Second Circuit of summary judgment for client in litigation brought under the Americans with Disabilities Act, and successfully defended against petition for certiorari to the U.S. Supreme Court
– Successfully represented a major international law firm in two appeals to the U.S. Court of Appeals for the Eleventh Circuit, which upheld the district court’s dismissal of $35 million tortious interference and fraud claim and the district court’s award of attorneys’ fees to our client under Georgia’s offer-of-judgment statute
– Obtained affirmance by the U.S. Court of Appeals for the Eleventh Circuit of judgment for client, a county Board of Elections, in defense to redistricting challenge

State Appellate Cases
– Successfully represented client on a securities law issue of first impression before the Georgia Court of Appeals and the Supreme Court of Georgia and obtained a unanimous decision in client’s favor from the Supreme Court—resulting in dismissal of claims for nearly $200 million in damages
– Petitioned for certiorari to the Georgia Supreme Court and obtained expedited ruling that the Court of Appeals had improperly denied our client’s motion for a stay pending appeal of trial court’s order disqualifying a major international law firm
– Successfully argued in the Georgia Supreme Court on behalf of Georgia’s Attorney General in a suit brought by the Governor seeking to compel the Attorney General to dismiss an appeal pending in the U.S. Supreme Court
– Convinced the Georgia Court of Appeals to reverse trial court’s certification of state-wide consumer class action against a pest control company
– Secured affirmance by the Georgia Court of Appeals of $28 million fee awarded to class counsel in lawsuit brought by retired educators regarding underpayment of retirement benefits
– Briefed numerous successful applications for interlocutory appeal to the Georgia Court of Appeals as well as successful petition for certiorari following denial of application for interlocutory appeal
– Won affirmance by the Georgia Court of Appeals of $1.5 million award in favor of lending institution and dismissal of counterclaims, and successfully defended against petition for certiorari to the Supreme Court of Georgia
– Rogers & Hardin has also been counsel of record in state appellate courts outside of Georgia, including those in Mississippi, North Carolina, and South Carolina
