U.S. Supreme Court Denies BP's Deepwater Horizon Settlement Agreement Challenge

December 2014
The U.S. Supreme Court today announced that it had denied BP’s petition for certiorari, which challenged the objective causation tests in the Deepwater Horizon settlement agreement. This development provides certainty and clarity as to the process and remedies for settling claims and is good news for businesses affected by the 2010 oil spill.

One consequence of the announcement is that the agreement’s six-month deadline for filing claims is triggered as of today, meaning that the filing deadline will be June 8, 2015 unless otherwise extended.
